Ohio court overturns death sentence for convicted murderer, orders new trial Posted: 04 Oct 2017 12:27 PM PDT A divided Ohio Supreme Court on Wednesday overturned the death sentence of a man convicted of murdering a female bartender and ordered a new trial, saying prosecutors erred in showing jurors knives not used in the crime that the man owned. The 4-3 ruling sends the case of defendant Joseph Thomas back to Lake County for a new trial. Thomas, 33, of Perry Township, in northeast Ohio, was convicted in 2012 for the kidnapping, rape and aggravated murder of bartender Anne McSween, 49, which occurred two years earlier in Mentor-on-the-Lake, located about 30 miles east of Cleveland. |
Gunman Stephen Paddock was helped by some of the most relaxed gun laws in the US Posted: 03 Oct 2017 06:55 AM PDT Stephen Paddock, the Las Vegas gunman, was helped by Nevada having some of the most relaxed gun laws in the US with the governor, Brian Sandoval, being given an "A" rating by the National Rifle Association. In 2014 the NRA gave Mr Sandoval a glowing endorsement as he ran for re-election. "As Governor, Brian Sandoval has consistently showed his commitment to the Second Amendment by signing important pro-gun reform legislation, including measures to improve Nevada's concealed carry law," said Chris Cox, chairman of the NRA's political victory fund. Mr Sandoval earned the NRA's praise for vetoing a bill which would have tightened background checks on all gun sales in the state. He said the bill did "little to prevent criminals from unlawfully obtaining firearms." Concert-goers take cover during Las Vegas shooting 00:34 "Senate Bill 221, while laudable in its efforts to strengthen reporting requirements concerning mentally ill persons, imposes unreasonable burdens and harsh penalties upon law-abiding Nevadans, while doing little to prevent criminals from unlawfully obtaining firearms," Sandoval wrote in his veto statement." His veto came at a time when there were growing calls for gun laws to be tightened following the Sandy Hook massacre in December 2012 which claimed the lives of 20 children and six staff members at an elementary school in Connecticut. Mr Sandoval, who justified his stance as protecting Americans' second amendment right to bear arms, was condemned by critics, including Michael Bloomberg, then the New York mayor. "Rather than sign sensible legislation that keeps guns out of the hands of convicted felons and the mentally ill, Governor Sandoval has decided to preserve the loopholes that they use to buy guns," he said. Nevada also imposes no restrictions on the capacity of magazines which firearms enthusiasts are able to clip onto their guns. In brief | Worst US mass shootings Large capacity magazines, capable of holding up to 100 rounds of ammunition, make it possible for a shooter to kill and maim a large number of people very quickly. Adam Lanza, the gunman at Sandy Hook, had fitted 30-round magazines to his weapon, making it possible for him to fire 154 rounds in under five minutes. In common with all but eight states, Nevada imposes no restrictions on magazine - or clip - size. During the 2016 presidential election, Hillary Clinton called for assault rifles, currently only banned in seven states, to be outlawed. Brian Sandoval Credit: Sam Wasson/Getty Paddock's lethal potential was increased by using devices known as "bump-stocks", which effectively turned his semi-automatic rifle into a machine gun - weapons which have been illegal since 1986. "This replacement shoulder stock turns a semi-automatic rifle into a weapon that can fire at a rate of 400 to 800 rounds per minute," warned Dianne Feinstein, a Democrat senator from California. Several of the weapons recovered from Paddock's hotel room and home had been modified. |

Archaeologists in Turkey believe they have discovered Santa Claus's tomb Posted: 04 Oct 2017 04:37 AM PDT Archaeologists in Turkey have made a discovery which could settle a century-old debate … and disappoint millions of children around the world. They have unearthed what they say is likely the tomb of the original Santa Claus, or Saint Nicholas, beneath an ancient church in Demre, southern Turkey. Demre, previously known as Myra, in Antalya province, is believed to be the birthplace of the 4th century bishop. Cemil Karabayram, the head of Antalya's Monument Authority, said the shrine was discovered during electronic surveys that showed gaps beneath the church. "We believe this shrine has not been damaged at all, but it is quite difficult to get to it as there are mosaics on the floor," Mr Karabayram told the Turkish Hurriyet Daily News. He said he is very optimistic about uncovering Saint Nicholas's remains, but warned it will take some time to scale each tile one by one and remove them as a whole in a mold. Turkish experts claim that what was believed to be the original grave of Saint Nicholas (pictured) was in fact the grave of an anonymous priest. Credit: Creative Commons "We have obtained very good results but the real work starts now," he said, adding that the temple is almost fully intact but currently inaccessible due to the presence of stone reliefs that need to be preserved. "We will reach the ground and maybe we will find the untouched body of Saint Nicholas." Professor Sema Dogan, excavation leader, was stunned by the finding and believes the discovery could boost tourism to the area. At the time of his death in 343 A.D., Saint Nicholas was interred at the church in Demre, where he lay undisturbed until the 11th century. Previously, the remains were believed to have then been smuggled to the Italian city of Bari by merchants in the year 1087. Christians visit the site of what was thought to be his final resting place in Bari's Basilica di San Nicola. However, Turkish experts are now claiming the wrong bones were removed and those taken abroad belong to another, local priest, rather than the legendary bishop. Christmas myth | Santa Claus is American Saint Nicholas of Myra was known for his generosity towards children. He had a reputation for secret gift-giving, such as putting coins in the shoes of those who left them out for him, a practice celebrated on his feast day, December 6. He was popularised in 16th century Europe as Father Christmas, who gave presents to young children. Dutch arrivals to the United States called their version of Saint Nicholas "Sinterklaas," which later became Santa Claus. Saint Nicholas is depicted in modern images as a portly old man sporting a big white beard and spectacles. |
